Professor Judith Fischer has drafted a great article on how to transform dull writing into exciting writing (to the extent that legal writing can be exciting).  You should follow her advice if your goal is to keep your reader awake.  She identifies 10 tips for improving your writing, including using strong verbs (e.g., “yelled” instead of “stated”) and avoiding nominalizations (e.g., “argued” instead of “made the argument”).
